Welcome to Boudoir by EBA. These Terms of Service ("Terms") govern your use of our website, products, and services (“Services”), provided by EBA Photography LLC (“Company,” “we,” “our,” or “us”).

1. Services Provided
EBA Photography LLC provides professional photography services, including but not limited to:
Boudoir photography sessions
In-studio hair and makeup services (where included)
Access to client wardrobe and props (where included)
Image reveal and ordering sessions
Print and product sales, including albums, wall art, and digital collections
Client education and support through guides, emails, and other resources
We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
2. Use of Services
You agree to use our Services in compliance with all applicable laws and regulations. You must not use our Services for any unlawful or unauthorized purpose, including but not limited to unauthorized reproduction, distribution, or misuse of photography and digital products provided by us.
3. Session & Booking Terms
A signed contract and payment of the session fee (non-refundable) are required to secure your booking.
Session dates are reserved on a first-come, first-served basis.
Cancellations, reschedules, and no-shows are subject to the terms outlined in your signed photography agreement.
4. Client Responsibilities
As our client, you agree to:
Provide accurate information during booking.
Abide by your signed contract and payment plan terms.
Respect studio policies, including punctuality and use of client wardrobe/props.
Use purchased images and products only for personal use unless otherwise agreed in writing.
5. Payment Terms
All payments are due as outlined in your invoice or contract.
The session fee is non-refundable under any circumstances.
Split or installment payments must be paid in full regardless of cancellation.
Unpaid balances may be subject to collections.
Products (digital or physical) will not be delivered until payment is received in full.
6. Intellectual Property
All images captured by EBA Photography LLC are protected by copyright law. We retain all copyrights to the photographs.
Clients receive usage rights only as specified in their purchased package or contract. Images may not be altered, copied, scanned, or reproduced without prior written consent.
7. Confidentiality & Privacy
Both parties agree to maintain the confidentiality of proprietary and personal information shared during the course of the engagement, unless disclosure is required by law or consented to in writing.
8. Limitation of Liability
Our Services are provided “as is.” EBA Photography LLC is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our Services, including but not limited to dissatisfaction with images, products, or delays caused by factors outside of our control.
9. Termination
We may terminate or suspend Services if you breach these Terms or your signed contract. Upon termination, you must cease all unauthorized use of our materials and return or destroy any confidential information.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on our website and become effective upon posting.
